Board of Adjustment Cases for October 21, 2021 at 6:30 PM:  

BOA Case No.  21-13  Appeal Decision of Zoning Administrator for property at 6223 Pinnacle Place: Property owner was directed to limit client vehicles on premises to four at any one time no more than two days in any one week in association with a home occupation at the subject address.  The property owner has submitted an appeal to the board of adjustment to overturn or modify the above-described limitations.  A staff report and items related to this request will be updated and made available at the following link by or before October 15, 2021:  Click here to open pdf.

BOA Case No.  21-14  Variance regarding 6' fence in front yard setback for property at 9816 Newport Vista Drive:  The aforementioned property owner seeks approval of a variance to Chapter 166.27.4.A.1 of the City of Johnston Code of Ordinances to allow a 6’ privacy fence between front yard property line and front yard setback along the NW 99th Street frontage.  A staff report and items related to this request will be updated and made available at the following link by or before October 15, 2021 :  Click here to open pdf. 

BOA Case No.  21-15 Special exception to allow 6' fence in front yard setback for property at 5384 NW 90th Ct.:  The afformentioned property owner seeks approval of a Special Exception to Chapter 166.27.4.A.1 of the City of Johnston Code of Ordinances to allow a 6’ privacy fence between front yard property line and front yard setback along the NW 54th Avenue frontage.  A staff report and items related to this request will be updated and made available at the following link by or before October 15, 2021:  Click here to open pdf.

PZ Case No. 21-28; West Park PUD Amendment

October 6, 2021

RAL, LC Johnston Series has submitted a written request to change the allowed uses of Lot 20 West Park Office Plaza Plat 1 in the West Park Planned Unit Development to facilitate development of a 10,000 s.f. pet resort and spa offering pet daycare, overnight boarding, grooming and retail sales.   

Chapter 168.11.7 of the City of Johnston Code of Ordinances allows for modifications to a PUD in the same manner as a rezoning:  after receipt of a recommendation from the Planning Commission, the City Council must hold three readings of the proposed ordinance and conduct a public hearing on the amendment.  A concept plan is available here: click here to open pdf.

PZ Case No. 21-25; Johnston Commons Planned Unit Development Amendment and Amendment #3 to the Johnston Thrive 2040 Comprehensive Plan.

October 6, 2021

S4 Properties, LLC, has petitioned to change the allowed uses of Lot 10 of Johnston Commons Plat 3, located within Parcel ‘H’ of the PUD, from C-2, Community Retail Commercial District to C-2 or R-4, Multi-Family Residential District. The request is made to allow expansion of the south-adjacent townhome use through construction of approximately 57 townhome units over Lots 9 and 10 of Johnston Commons Plat 3 (Lot 9 currently allows C-2 or R-4 uses.  A concept plan is available here:  click here to open pdf.

PZ Case No. 21-15; Ignit Sports and Fitness Zoning Map Amendment

August 20, 2021

Ignit Johnston LLC has requested a rezoning of approximately 31.59 acres from CD, C-3, M-1, A-2 and PUD to Planned Unit Development (PUD) allowing for the construction and operation of an indoor/outdoor sports and recreation complex.   (click here for concept).

Jennx, Inc. has requested a rezoning of approximately 21.67 acres from Planned Unit Development allowing uses of the Professional Commerce Park District to Planned Unit Development allowing detached single-family association homes at a density not to exceed four units per acre (click here for concept).
